Welcome to Kissa! These Terms of Service (“Terms”) govern your use of the Kissa mobile application (“App”), operated by Kissa LLC. (“Kissa,” “we,” “us,” or “our”). By using our App, you agree to these Terms. Please read them carefully. If you do not agree, do not use our services.

1. Acceptance of Terms

By accessing or using Kissa, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with these Terms, you may not use the App.

We may modify these Terms from time to time. If we make changes, we’ll provide notice through the App or other means. Your continued use of Kissa after any changes indicates your acceptance of the new Terms.

You agree not to use Kissa in any manner that:

7. Content Ownership and License

  • User Content: By submitting any content (such as reviews, photos, or coffee recommendations), you grant Kissa a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your content within the App and for marketing purposes.

  • Kissa Content: All materials provided by Kissa, including but not limited to logos, design, and software, are the property of Kissa. You are granted a limited license to use the App for personal, non-commercial use.

8. Prohibited Activities

Users may not use Kissa to promote unrelated products, services, or commercial interests. Unauthorized use of bots, scrapers, or any automated tools to collect information from the App is prohibited.

9. Third-Party Services

Kissa may contain links to third-party websites or services. These are not controlled by Kissa, and we are not responsible for their content or privacy practices. Access them at your own risk.

10. Termination

We may suspend or terminate your access to Kissa at our sole discretion if we suspect you have violated these Terms. You may also terminate your account by contacting us directly.

11. Disclaimer of Warranties

Kissa is provided "as is" and "as available." We make no warranties, expressed or implied, regarding the reliability or accuracy of the App’s content or its uninterrupted availability.

12. Limitation of Liability

To the fullest extent allowed by law, Kissa is not liable for any damages arising from your use of the App, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of California. Any disputes arising from these Terms will be resolved exclusively in the courts of California.
